Canada’s Proceeds of Crime (Money Laundering) and Terrorist Financing Act (Bill C-22) helps governments and law enforcement and intelligence agencies understand and restrict how criminal and terrorist organizations use financial systems to further their objectives.  It is a key element of this nation’s security system and contribution to international security. Thousands of organizations and hundreds of thousands of individuals must now report suspicious financial transactions and in the near future will need to add the reporting of large cash transactions and wire transfers over $10,000 Canadian equivalent to their compliance routine.  Later this year, the final stage of the reporting requirements will be put in place with new regulations about funds (cash or near-cash) entering and leaving the country.

A significant number including: banks, credit unions, loans and trust companies, accountants, casinos, life insurance companies, independent life insurance agents and brokers, all securities firms and independent dealers, real estate brokers and sales persons and also businesses offering money services (currency exchange, money transmitters, money order sales).

They should have started to put in place the compliance regime that the law now requires and they should have been reporting suspicious financial transactions.  The reporting of suspicious transactions began 5 months ago and the potential maximum penalty for having failed to submit a report can run as high as 5 years in prison and/or a fine up to $2 million.
