Canada’s Proceeds of Crime (Money Laundering) and Terrorist Financing Act (Bill C-22) helps governments and law enforcement and intelligence agencies understand and restrict how criminal and terrorist organizations use financial systems to further their objectives.  It is a key element of this nation’s security system and contribution to international security. Thousands of organizations and hundreds of thousands of individuals must now report suspicious financial transactions and in the near future will need to add the reporting of large cash transactions and wire transfers over $10,000 Canadian equivalent to their compliance routine.  Later this year, the final stage of the reporting requirements will be put in place with new regulations about funds (cash or near-cash) entering and leaving the country.

They should have started to put in place the compliance regime that the law now requires and they should have been reporting suspicious financial transactions.  The reporting of suspicious transactions began 5 months ago and the potential maximum penalty for having failed to submit a report can run as high as 5 years in prison and/or a fine up to $2 million. If you have started that process are you aware of the latest changes and requirements?  Are you convinced you have put in place all the appropriate elements?  If you have yet to start, can you afford to risk a $500,000 fine for non-compliance?  This is criminal law and ignorance of the law is no defense.
