Subject: US estate tax

Dear Mr. Ingram,
Are there US estate tax complications for a US citizen wife (Canadian permanent res. since 1971) with a Canadian citizen husband?

Yes there are.  In addition, you should be filing a US tax return each year even if you have no US income.

 
If you have or control more than $16,000 in Canadian Banks, RRSPs, Credit Unions, Canada Savings Bonds, etc., there are severe penalties for not reporting them...
 
And Internal earnings in a Canadian RRSP have to be reported on the US return although we can exempt the tax on the income under Article XXIX.5 of the US / Canada income tax treaty.
