Renting to family & tax deduction -

QUESTION:
I've recently bought another property and plan to keep my current home which
I will rent to my mother.  I want to take the equity in my current home to
pay off my new home which will become my primary residence.  Are there any
problems renting to family?  Can I take the equity in my home and pay off my
new home and still deduct the mortgage interest? Is there a better option I
should consider?

There are three cases that say that if you borrow money on a rental house to
do anything personal, the interest is not deductible.  Therefore if you
borrow on the old house to buy the one you will be living in the interest on
that part of the mortgage on the old house is NOT deductible whether you
rent it to your mother or a complete stranger because the PURPOSE of the
loan was to buy a personal item.
In other words, it does not matter what the security is, it matters what the
money was borrowed for.
The Eva Huber and Manfred Holman cases and indirectly the Bronfman Estate
Supreme Court Decision make that clear.  In addition Bulletin IT-533
codifies that fact.
