Hi,
I am a Canadian Citizen currently working in USA with TN Visa. I started
the Job on July 6th 2003. My employer paid me expenses for relocation and
tax gross up. This expenses are included in my income statement (w2).
Since I am not in USA for 183 days, IRS considers me as Non Resident Alien
for 2003.
Therefore, I have to declare myself as resident of Canada for whole year.
Here are several questions:
1) Can I claim my relocation expenses since it is included in my income.
2) Can I claim the tax gross up as taxes paid to USA
3) Can I get credits for Social Security and Medicare I paid USA. Since I
paid CPP and UI in Canada for first 6 Months (reached the maximum limit),
will get them back?
Thanks
CXXXXXXXXX

david ingram replies:
Not true, Not true. If you went on a TN and intended to stay in the US, you are a departing resident of Canada and will only report the "Canadian" income on the Canadian Return. You will pro-rate your exemptions.
Your US return will be an "arriving Dual-Status" tax return.
This will save you thousands in tax and is the way your return should be done.
1. Yes - on your US return on schedule 3906
2. N/A
3. N/A
4. N/A
You should send your return to us in West or North Vancouver. The cost for the US, State and Canadian return will be between $700 and $1,000 Cdn but they will be done correctly and you will not be trying to find someone to do one part and someone else to do another part
