QUESTION:
Hi,
Your daily mailings are very helpful. Thanks.
questions:
I landed in Canada as a PR in July, 2001, and went back to U.S. on H1, and frequently visited my friends in Windsor, ON from MI. Finally moved to Windsor in Jan, 2002. Should I have filed Canadian taxes for year 2001 in order to count those days that I spent in Canada following landing towards citizenship.
Thanks

david ingram replies:
If you were not living in Canada or working in Canada in 2001, you do NOT have to file a Canadian return for 2001 unless you were in Canada more than 183 days in 2001 which would include the days after you received your PR card PLUS the days before you received your PR card.
In this case, you would have to pick a date that you actually started being here and report the MI income you earned after that date.
If you were only here 150 or 120 days in 2001, forget it.. If you were here all of 2002 and 2003 until now, you already have your 2 out of 5 years residency requirements met.
