Corp-to-corp contract between US and Canadian based companies

Hello,

We are based in US and would like to do corp-to-corp
contract with a Canadian based company which supplies
us a consultant to work in the US. Will there be any
issues in doing this corp-to-corp contract? Please let
me know.

Depending upon what the job is, the worker or consultant who is going to be
working in the United States needs a visa with one exception.

The exception would be where he or she was going to your facilities in the
US, gathering information and coming back to Canada to do the work, write up
the report, analyze the data, etc. In this one case, he or she would
qualify to go to the US in a B1 (business visitor) status. In the case of a
B1, the individual, would NOT be moving there and would only be there
sometimes or occasionally.

Otherwise, a professional person with about 63 different professions can go
south as a TN (Treaty NAFTA) visa holder which allows him or her to perform
their duties in the US and be paid by the Canadian or the American
companies.

Without a degree and without a TN designation, your consultant may qualify
to go south as an H1 visa holder or might even be transferred under an L1 if
the Canadian Company were to open a branch office in the US and transfer the
individual there.
