EVICTION NOTICE IN DIVORCE - BRITISH COLUMBIA

I have a situation where a separated couple have the following facts:
After a twenty year marriage, the wife moved in with another man.  The family home was in the wife's name through a constructive trust for 18 of those years.  
The husband and children remain in the family home.  
After three months of separation, the wife is now claiming that the husband is a tenant and has issued a 60 day eviction notice because she intends to move into the home with  the new boy friend.
Has anyone on this list heard of a similar situation?
