Dear Dave:
Bad situation here, I am a Canadian citizen, with dual citizenship in U.S.A . I am a carpenter who earns about 30,000 a year. I going to the states, for a bit. I am divorced, and pay extortion money to my ex, 9000.00 year child support, canadian taxes about 8,500 year. I can't live on about 10,000 year, I lost everything, I don't drive now, am bankrupt in Canada , personal and corporate, have been living in homeless shelters and friends couches. Am in a total financial maze, and the U.S seems to be my only escape for the moment, to get out of the fire.
How do I make it work in the states,so that I can come back to Canada one day? I love my son beyond belief, and am not trying to be a "deadbeat", but cannot believe what is going on in Family court in Canada.
Tell me how long to live in the states and what tax advantages I can obtain being a U.S/ Canadian. I understand I can earn 10,000 a year in Canada and not have to claim it in the states. I am going to Florida to take advantage of no personal state taxes, help me draw up a plan, so I can remain in my sons life.
How do I go bankrupt in canada while living in the states? I will do anything, but cannot even support myself here> I need to go bankrupt but cannot afford a trustee of bankrupcy, or even get my company books in order as I cannot afford the accountants fees,
I am totally at a loss as what to do, and can only see crossing the border
Sincerely
EXXXXXXXX

I am in the middle of my own $4,800,000 bankruptcy and a marital disruption so believe it or not, I have an idea of how you feel.
However, running for the states will just prolong the agony and leave you with more problems in the future.
Get in touch with Murray Morrison at 604 930-9013. He is a bankruptcy lawyer, not a trustee. Spend half an hour with him and determine your legal position.
Then go and see Gerry Foran at Sands and Co. -at 604 684-3030
Just remember that the Trustee is working for your creditors. His role is to get the most money for them. Doesn't mean that he (Gerry) is not a nice guy, but after you hire him or pick him (or her) the trustee is working for your creditors and will put you through a series of legislated procedures which will drive you nuts (I know from personal experience). The trustee is not being mean and it is nothing personal, it is just what happens.
I was put through a special examination at the Superintendent of Bankruptcy's office and my wife and I were put through extra special examinations of 7 hours and 5 hours while the Trustee looked for the hidden millions. Just remember that if you always tell the truth, you do not need to remember what you said.
It is possible to go bankrupt without putting much money down and I GUARANTEE YOU that it is the smartest thing to do in the situation you describe. All trustees I know of will take payments or get their money from the limited assets that exist, if any. If you are working, the trustee can take his or her fee form your tax refund.
Whatever you do, do NOT run before you give Murray (or a bankruptcy lawyer like him) a chance to tell you your rights and represent you. You will find it handy to be able to call him BEFORE you answer or deal with the trustee, because remember, the trustee works for the creditors, not you..
Get the bankruptcy dealt with first. THEN head for the border. In the meantime, because you can, why not just find a job in Washington State. the tax rate is the same as Florida and you will be close by to deal with the trustee and your bankruptcy AND you will be close enough that you can still see your children.
And, on that note, if you happen to be a father who is being denied access to your children, Carey Linde is a great Divorce Lawyer who specializes in Child access and custody for fathers. You can contact him at (604) 684-7794.
And if you are wonderiong why I am answering this at 4:55 AM, it is because I am sitting up with my kids watching "Two Weeks Notice" with Sandra Bulloch and Hugh Grant on Movie Central. Now, I am going to try and go to sleep.
