My question is: US-specific
QUESTION: My sister got her family home in her divorce in lieu of his pension. He quick claimed the house to her, but still has the loan in his name (she could not qualify). She remarried him and now wants to divorce him again, does he have rights to the house again?

david ingram replies:
There are seven different community property laws in the US depending upon which state you live in and there are another 20 possibilities for states that do not have community property.
I do NOT know the answer because the question is state specific and should be dealt with by a local attorney. However, even though logic is relatively rare in contested divorce cases, logic would seem to be that if he moved back in and the mortgage is in his name, he would have a new claim to the house.
However, under the same logic, your sister would have a new claim to his pension.
----------------------------------------------------
In my case, my wife walked out the door and moved in with another man back on June 19th. She left the kids, the cats, her dog and me.
The new man asked her to leave after New Year's and now she is suing me for custodyt of the kids, alimony, child support, all the house, all of her apartment and I guess that would include the kitchen sink. Some people just can't make up their minds.
And, that is why we have law and lawyers. Some lawyers just see $350.00 an hour stenciled on their client's foreheads. Others are god-sent to help in difficult and emotional situations.
Good luck to your sister.
