QUESTION:
I am recently divorced and the court ordered retroactive lump sum spousal
support payments. The court order was specifically written " to be
considered monthly payments for income tax purposes". However after
registering my court order with customs and revenue Canada, they rejected my
claim for this payment and said it is not tax deductable. Do I have any
options or must I swallow this $10,000 tax bite? Thankyou XXXx

david ingram replies:
Lump sum payments upon divorce are not deductible for you and they are not taxable to your "ex".
Monthly support payments based upon a proven need are deductible to you and taxable to your ex. It should be clear.
Your agreement seems to be poorly written. I would be glad to look into it. The least you should do is file a notice of objection.
