Dear Mr. David Ingram,
We are citizens of Ukraine. I am working for the USA Company from April, 2000. I've been paying taxes in the USA all these years. Last 2 years I also had additional income from one of my Internet Projects. I have income from 2 sources: 1. My employer; 2. My small Internet Business. (I am doing web-development, web services)
In 2002 we received Canadian immigration documents and in 2003 my wife decided to move to Canada and try to find a job there. I am also planning to move to Canada in next 2 years.
In May 2003 we moved some furniture to Canada, registered my wife's car in Ontario and my wife exchanged her USA driver's license to Ontario license. She started looking for job. (She can not work in the USA because of the restrictions of her visa.)

In June 2003 I opened DBA bank account (soul proprietorship) in Canada for my Internet Business. I requested my clients to send checks to Canada instead to the USA.
Now I think that I was probably not a good idea because it might be confusing for tax calculations.
I were staying in the USA all time working for the USA Company and also working on my Internet Business. I visited my wife a few times while she was staying in Canada.
Unfortunately she wasn't able to find a job and we decided that it will be a good idea for her to go to college. We are still reviewing variants and we have not decided if she will study in the USA or in Canada.
She was staying in Canada for about 3-4 month and then my wife moved back to stay with me in the USA. We visited Canada a couple of times after this.
My annual income with USA employer is about 60000=00. I received on my Canadian bank account for my Internet business about 4000=00 in 2003.
I understand I have to pay taxes in the USA from my total income: 64000=00.
What taxes do I have to pay in Canada? Can you please give me an estimate?
Do you think you might help me with my taxes?

Thank you. Best regards,
RRRRRRRRR

david ingram replies:

Somone will have to help you with your taxes. What an interesting set of facts:

1. Your internet business is undoubtedly in violation of your visa. You likley have an L1 or H1 visa and those visas do NOT allow you to set up a separate and private business. The visas do not allow you to perform any services (even volunteer) for anyone other than the employer whose name is on your visa.

However, since you performed the internet services in the USA, they are taxable on your internet services on your US 1040. They are not taxable in Canada because you did not perform any services in Canada.

I would be glad to calculate your tax returns for you.
