US Citizen on a Temporary Work Permit in Canada -

QUESTION:
I am a US Citizen and have been on a consulting contract in Canada for approximately 3 months. Customs required me to get a work permit - so I did. The company that pays me for my services rendered to the client, is straight wages and expenses with no taxes taken out. They pay me via check (Canadian dollars) sent directly to my home. How do I claim this in Canada and the US or do I only do US. Please advise.

david ingram replies:
You will always be taxable in the US. It is a question of whether you will be taxable in Canada and will depend upon your contract. If you are historically a self-employed person and you are still self-employed with no fixed base of operations in Canada, you would be Canadian Tax free under Article XIV of the US / Canada Income Tax Convention.
If you are ruled or are an employee with no benefits, then you are tax free in Canada Under Article XV of the Treaty if your earnings are under $10,000 Canadian and taxable on everything if you earn over $10,000.
You are likely in the second position because you refer to your check as wages and do not show the mental thought process of a self employed person.
