TN or L1 Visa per 1603.D.1 NAFTA cross-border

QUESTION: My company has offered to transfer me to the US on a TN1 Visa as a
Senior Marketing executive.  My fiancee is also a marketing executive, based
in Canada.  My company is willing to consider trying to secure her a work
visa too...is this a pipe dream or is there some way they can do this?
Does the TN1 Cover this type of work?  Does a sponsor need to be your
employer (based on the idea that my company may look to secure a work visa
for my fiancee, even though she would look to work for another company).
We both have 2 University degrees, are canadian citizens.  I have a B Comm
and an MBA, she has a BComm and a Biology degree.
Please advise - just trying to figure it all out!!

With really "rare" exceptions, a TN visa would not cover a sales job of any
sort.  An exception would be if you were a nuclear scientist selling nuclear
reactors where your degree was necessary to the job.
Marketing executives are not on the NAFTA list.
If you are already working for a Canadian company with a US branch or a US
company with a Canadian Branch, they can transfer you as a manager,
supervisor, etc under a L1 visa.
The Section 16 Working Group's 1603.D.1 NAFTA list is as follows:

1 A business person seeking temporary entry under this Appendix may also
perform training functions relating to the profession, including conducting

2 "State/provincial license" and "state/provincial/federal license" mean any
document issued by a state, provincial or federal government, as the case
may be, or under its authority, but not by a local government, that permits
a person to engage in a regulated activity or profession.
3 "Post-Secondary Diploma" means a credential issued, on completion of two
or more years of post-secondary education, by an accredited academic
institution in Canada or the United States.
4 "Post-Secondary Certificate" means a certificate issued, on completion of
two or more years of post-secondary education at an academic institution, by
the federal government of Mexico or a state government in Mexico, an

5 A business person in this category must be seeking temporary entry to work
in direct support of professionals in agricultural sciences, astronomy,
biology, chemistry, engineering, forestry, geology, geophysics, meteorology
or physics.
6 A business person in this category must be seeking temporary entry to
perform in a laboratory chemical, biological, hematological, immunologic,
microscopic or bacteriological tests and analyses for diagnosis, treatment
or prevention of disease.

Your fiancée has a better chance for a TN than you do with her Biology
degree.
Only the company hiring the Canadian can apply for the Visa.  Your company
can NOT get her a working TN visa unless she is working for your company.
They may offer to pay for the services so that someone else can hire her but
the company that hires her has to apply for the visa.
