Hello:
I'd like to find out if you know any lawyer in Dallas/TX area who can
help me file my TN and TD renewal(my wife)via mail. My wife has a
Pakistani passport and it has valid TD visa till 2008, she got the visa
in Pakistan at American embassy. Will this be a problem since TD visa is
only given for 1 year? Her current passport also expires on July 4th,
2006 and our TN/TD expires on January 14th. Will this be a problem? Will
she have to get new visa?

Hi there,
I have heard you can renew a TN visa by mail but I am unable to find any
information on how to do so. I am a nurse from Canada. Could you point
me in the right direction? Also what forms/documents are needed? What is
the cost?
Also I have heard of a some nurses from Canada that have renewed their
TN visa's when coming back from Mexico. I am going to Mexico in a few
months and I am wondering if that is an option or not (to renew when
going back through customs in the US). I will be flying.

You can renew by mail by sending the information to Lincoln Nebraska.
Send it 2 1/2 months BEFORE your existing TN expires.  DO NOT leave the
country until your renewal has come through.  If your status has
expired, you can NOT renew by mail because you must be "in status" to
renew by mail.  If your status has expired, you must go to a land
border,  Remember, that if you are in Texas or California, you can go to
Mexico to renew at a land border.  The USCIS person at the border will
not likely be adept at processing the paperwork, because they do not
regularly renew them but they are authorized to do so. People in Florida
can take a day trip to the Bahamas and do the same thing.
You will need:
I-129 Petition for Non-Immigrant Worker - use this form to renew or
extend
your TN status.   The fees is $130.00.
The I-129 ( http://uscis.gov/graphics/formsfee/forms/i-129.htm )
petition may be used by the employer for multiple petition renewals.
Therefore if several TN's are due to expire at approximately the same
time send them in together for the same $185.00 fee.
Make sure that you check the latest fees at the INS Website

I-539 (http://uscis.gov/graphics/formsfee/forms/i-539.htm ) Application
to Extend/Change Non-Immigrant Status - use this form if you have
dependents under the TD status.  The fee of $195 is good for all of your
dependents.
Give it to your employer to send in at the same time and the employer
will likely pay both fees.

You should / must include the following documentation:
1. Front and back copies of your I-94's, 2. Copies of your Canadian
Citizenship Card, Canadian passport, or Canadian birth certificate 3. An
original renewal letter on company letter-head. This will be very
similar to the original letter used to obtain your TN status.
4. Copies of the education diploma/degree, or transcripts used at the
time you obtained the first TN.
5. If you were required to prove experience, copies of all such proof
that was provided when you received your original TN status.
6. Send PRIORITY POST with PROOF OF RECEIPT. You "Might" have to prove
that you sent it on time!
7. SEND A COVER SHEET listing everything you have included with your
package. Put the cover sheet on top of everything so that the USCIS
person opening the envelope sees it first.
8.  Of course, include your check!
 Check the USCIS Fee Schedule before sending any money.
