Dear Mr. Ingram,
I'm at my wits' end, I don't understand all the customs sites. I
have heard that you are sympathetic to cases like mine.   Can I
please tell you my trouble?
I'm a US citizen married to a Canadian, and we've just moved to
Quebec.  Shortly before our move, my husband went to Canada to
close on our new home, and when returning to the US, they
confiscated his green card, saying that he was committing "fraud"
if he was going to live in Canada.  Fine.
In order to avoid heavy Quebec taxes, my husband signed over the
title of the  car to me less than a week before leaving the US.
We went to the MVB in Goshen, NY.  They took the ownership
certificate and said it would take 6-8 weeks for us to get the
papers. ( I should let you know that due to vision problems, I
cannot drive, and my husband does all the driving.)
LAst week, when we went through Canadian Customs at St. Bernard
de Lacolle, we were told that we would need to export the vehicle
from the US.  Since they had already let us into Canada without
doing so, they told us we could not leave Canada and that a
Canadian citizen with no status in the US could not drive a
vehicle with US plates on it.  My question is:  what can we do to
let the US know we are exporting our own vehicle with us on our
move to Canada being that we are already living here?  What forms
do we fill out?  Do we have to wait until the New York DMV
returns the certificate of ownership?  We still have US insurance
on the vehicle, is it valid in Canada?
I'm not sure if this makes much sense, because the entire
kerfuffle makes no sense to me.  If you could please point us in
the right direction, my husband and I would be very grateful.  I
don't know what else to do.
We are using a friend's computer until our personal belongings
arrive, so I may not be able to check my email again for a day or
so.

To export the car from the US, you have to take the ownership
papers to the US customs side.  South of Vancouver, the papers
have to be there three working days BEFORE you intend to export
the car.  And, they are only open to export from 8:30 AM to 3:30
PM Monday to Friday on non-holidays.  At Pembina North Dakota,
they will export 24 hours a day 7 days a week.
The Champlain border export office is open from 8:00 AM to 4:00
PM Monday to Friday.  (hint - do NOT show up at 3:50 PM).  The
direct phone number to the Export office is: 518-298-8335.  The
regular phone number is 518-298-7904 and the fax number is
518-298-2902.
I suggest that you fax them copies of whatever you have which
would preferably be a photocopy of your old title, a copy of the
insurance certificate showing you as the new owner and the old
insurance policy showing your husband as the owner.  Two or three
years of insurance certificates would be preferable.  The bill of
sale would be nice as well.  And, if it is financed, a copy of
the original finance papers.  I would fax these tonight with an
explanation (the one you have written me is likely as good as
any) and give them a phone number to phone you at their
convenience.  (The officers at the truck crossing south of
Vancouver are very good at phoning.)
See what they say, they may be willing to export the vehicle.  I
was not able to find out how many days they require the
information.
If that does not work and they insist on the original title (you
cannot blame them, they are looking for stolen cars), you will
just have to leave the car parked "until".
Another possibility is to hire a Customs Broker.  Livingston is
more than reputable and they deal with thousands of exports every
day from coast to coast.  Their contacts in Champlain are:

I am confused about why your husband transferred the car to avoid
tax however.  I can't figure that out at all.
