Employment income from Florida in the US. - David

QUESTION:
I am a Candian resident for tax (wife, home, etc. in Canada) and spent about
100 days in the US working for a US employer. in Florida. Based on review
of your (very helpful and informative) site, I think I simply complete a US
1040NR. What happeens to the social security and medicare tax that my US
employer withheld from my pay. How/can I get that back.
In addition, to I have to file a Flordida tax return (no state tax was taken
off my US pay cheque).
Thanks in advance for your assistance.

You are correct. You will file a US 1040NR - There is no State tax return
for individuals in Florida.
You will then report the gross US income on line 104 of your Canadian Income
tax return (you could put it on line 130 but it would not contribute to your
RRSP room there so put it on line 104).
Put the same amount on line 433 of your schedule 1 and maybe on schedule
T2036 if the foreign tax credit is not all used up by the Federal Tax.
Then you put the foreign tax paid - Not what was deducted but what was
actually paid on the 1040NR. To that figure, add the Medicare and FICA
(social security) taxes deducted, convert them to Canadian funds (as you
also did with the gross income you put on lines 104 and 433) and put this
amount on line 431 and on schedule T2036 if necessary.
Oh heck, just pack it all up and send it to me. We will look after it for
you by email, snail mail, fax or courier.
