My question is: Applicable to both US and Canada
QUESTION: Our friends are looking at purchasing / starting a new business in the Seattle area. The capital investment would be theirs; my husband would manage this business for them.
What would be the best way to approach this from an immigration perspective?
Does the E2 visa only apply to the individual who makes the capital investment? Would I be able to accompany my husband into the US?
I would have to seek alternate employment - would I be able to apply for a TN Visa once I'm in the US?
What kind of questions/information should we be gathering?

david ingram replies:
You will not like the answer. Only the investor qualifies for the E2 visa.
You can find a very good explanation of the E2 visa by going to www.centa.com click on newsletters, click on 1995, click on January.
This January, 1995 newsletter on E2 visas was written by Dennis Olsen, former US Consul in Vancouver who used to issue E2 visas in Vancouver before moving to Everett, Washington and opening a private US immigration practice.
.
If you, yourself have a University degree, you may be able to qualify under NAFTA for a TN visa. For more information on TN's and other visas and the
occupations that qualify, go to www.centa.com and click on ENTERING THE USA.
The TN part is at the end so you will have to page down but it would not hurt to read it all. You may come up with a different classification for your husband.
A more likely route to get your husband to the USA is for your friends to hire him now in Canada and then transfer him to the US operation a year from now. Yep read the L1 rules.
Hope this helps
