Hi,
I'm a canadian citizen and i am planning to go work in the NYC metro area as an independent contractor. I thought making a corporation in the U.S. and then apply for TN visas to go do contract in the U.S..
I would be getting back in Canada as often as weekly for 2-3 days at a time, so my situation must be really clear to insure i cross the border without any problem. I would continue doing contract work in Canada and would go for an incorporation here also.
Is this feasible and would you offer most of the services required to establish this.
Thanks for any information

You can not incorporate your own company and get yourselfd your own TN under those circumstances. You might actually get away with it but would end up in the glue if the situation came to light . Although not specifically spelt out, this was one of the subjects at a cross-border conference in Vancouver last year and it was very clear from the replies of the five US border people in charge that a one man company did NOT qualify for any TN let alone a computer system analyst which is one of the hardest to get.
On the other hand, you can have a dozen TN visas and if you apply for them all at the same time, there is only one processing fee for them all.
"IF" you qualify for one, you will get them all.
So, If you get a contract or have a string of contracts get a TN for each one.
TN's can be (and should be) taken out for a one day contract or they can be for a 365 day contract. DO NOT ASK for a TN for a contract for more than a year. If you ask for more than a year, they may not give you one for the year because the rules are that you should not be counting on going for more than a year.
You are a perfect TN because you intend to work in Canada at the same time. Do NOT incorporate in either country unless you want to find out just how expensive consultants (accountants) can be. Your cross border accounting problems could end up costing you $15,000 a year instead $1,000 as a cross border proprietorship. The only one making money will be the accountant and lawyer that sets it up for you.
If you end up with employees, etc, we can talk about it then.
You ask if I can look after it for you. The answer is yes.
