QUESTION:
If I were able to live in Ontario and commute daily to work as a RN in the USA, would my income be taxed by both countries? How would that work?
Thank you,
Amber Houghtling

david ingram replies:
You will have to be commuiting to some place like Niagara Falls, Detroit or Northern Michigan to do what you propose so the answer is simple.
You will work in the US and file a state return and a US 1040 or 1040NR.
After paying the US medicare, FICA and state and federal income taxes, you will report the same income on a Canadian T1 General return after converting theUS amounts to Candian.
Then you will claim the foreign taxes paid to the US on your Federal Schedule 1 and your Ontario Provincial tax calculation form.
You will end up paying the same rate in Ontario that you would have paid if your job was in Ontario.
. Depending upon how long you work in the US, you will likely end up getting Social Security. However, there is a catch. It is no longer sufficient to have Social Security benefits in yyour account, you now have to prove that you were working legally in the US when you apply.
You can't count on their records to prove this. Make sure you keep (forever) a complete record of your working visas so that you can prove it when you turn 65 or so. It is a good idea to keep a couple of copies.
Although a long distance away, we would be pleased to look after those returns when the time comes by mail or fax or email.
