I was horrified to read your response today to leaky condo potential landlord.  Please send him to the Condo Law FAQs forum at a consumer advocacy website at http://www.bccondos.ca, which provides advice from two Vancouver area Residential Tenancy Offices on the dangers of such an agreement.  Both e-mails are listed under the question, Is it OK for me to rent out my leaky condo?  In a word, no!

I do not understand your horror.  The site you mention http://www.bccondos.ca/forums/viewtopic.php?t=84 does not address the question asked.  
 The questioner did not ask if he or she could rent out the unit or should rent out the unit.  They asked if the repairs would be deductible if it was rented and my answer was "no". 
The question of liability for mold, etc. was not asked and is not necessarily relevant in this case. 
For instance, every condo in a leaky building does not leak.  One building on Alder (for instance) has a million dollar repair bill but no individual suite is leaky or mouldy.  The repair bill is to fix a wall BEFORE the leaks develop. 
In other buildings, two or three or five units are seriously affected but every strata owner has to pay for the repairs to the whole building.
I did the first known exposee of leaky condos in a program on CKO on Jan 27, 19"8"7 when I interviewed Ed Witzke.  Literally 80% of the leaky condos were built AFTER that date. 
I closed down my condominium sales organization in Dec 1992 because of my perception of the legal responsibility that Realtors would be liable for with the sale of leaky units.
