Thanks David,
Another question:
I am in the US as a dependent on my wife's NT Visa, so I have a ND visa, or something like that. As a result, I can't work in the US. But I now want to do some journalism, but don't want to upset the US Immigraiton authorities by "working" in the US. Can you please advise me if I can earn
any income while here? Do I need to apply at the border for a Visa as a journalist, and if so, how do I do so?
I do have journalist accredidation from an Irish publishing house.
Thanks,
SXXXXXX

TWO QUESTIONS: I should be charging you.
However, I like questions where I get to make a political comment at the same time.
Your wife has a TN visa - you have a TD status. That means you cannot work at anything in the USA which takes "any" job away from a US resident alien on citizen. That means, you cannot give someone a battery boost if they have been waiting two hours in the rain for a tow truck. You cannot go to the grocery store and buy groceries for your neighbour. You cannot volunteer at anything that others are usually paid for.
You cannot work as a journalist if the article or work is published by an American publication. On the other hand, you could get your own H1B visa and work as a journalist if someone would hire you and you qualify for an H1B. You would need proof of a lot of published works to qualify for an H1B if you do not have a Degree in Journalism from an acredited University
or college like Ryerson in Toronto.
Journalists were the only profession to have been removed from the TC status under the original Free Trade Agreement between Canada and the USA in 1989.
If, on other hand, you are talking about covering something for a foreign publication, that publication can apply for an "I" visa for you and then you could cover the event in the USA.
If you are just talking about writingf something on the internet which would be paid for by an Irish or Canadian company and you are not leaving your home to do this, you should just be able to do it because you are not taking any job away fromany American. I cannot show this to you anywhere in official writing. It is just that I have never seen anyone (writer, painter, musician) deported / evicted for doing something in the US that they are bringing back to Canada.
I have had many, many spouses in your position give up and come back to Canad because they can't take the inability to work any longer.
