Subject: Candian resident workin for Oregon Corp.
Hi David,

We are hiring an employee who is an Australian citizen who lives in Vancouver. We are an Oregon based Corporation with employees based around the US. This particular employee will be working for us but based in an office in Vancouver. He will be involved in field work throughout the year that will take him to the US for periods of time.

I am wondering if our company would be paying any unemployment taxes to Canada, or any other employer obligated taxes? How would our employee file his returns? In Canada, or in Oregon?

Also what about workers comp coverage for this employee? How is Canada set up for this.

Thank you for your help

You have two choices:
1. You can maintain your own payroll inwhich case, you need a Canadian Business number (similar to your EIN). Youi woul;d maintain a Canadian Payroll and make deductions for employment insurance, CPP (like FICA) and income tax for the Federal Canadaian Government and for the Province of British Columbia. In addition, you would have to register for the Provincial Workers Compensation Board and make payments to the WCB.
2. You could hire Sonja Clark in our office to do it for you. Sonja is / was a CPA in Oregon for 14 years and also a member of the Oregon Bar
She nows lives in Canada and is a member of the Institute of Chartered Accountants of British Columbia. She can handle both the payroll and your Canadian Corporate Income tax operations.

Your employee needs an H1B visa to work for you in the United States. As a Canadian Employee of an American company, he can not go to the states and perform any services without a working visa. I presume that you have this in hand. If not, I could likely help with that as well.

Your employee would be preparing a Canadian and British Coluimbia income tax return. If he was also performing services inthe US, he would have to file a US 1040NR and if in Oregon or California orNew York, he would have to prepare the relevant state returns as well.

Our office is set up to handle all of these returns with its specialty on cross border income tax.
