QUESTION:
I am a Canadian RN and I live in windsor and commute to work in Michigan. I
have been doing this consecutively for approximately three years. Am I
entitled to some kind of overseas tax credit either from the U.S. or from
Canada because of this? If so, How do I file for this benefit, Could You
give Me and e-mail address? or telephone number? Thankyou very much for
Your attention in this matter.
Sincerely, KXXXXXXX

david ingram replies:
There is an overseas tax credit on up to $80,000 CDN issued by Canada but you do not qualify for it.
To qualify:
1. you would have to be working in engineering or construction or mineral exploration or electronics. Nurseing does not qualify
2. you would have to be working for a company or organization which had at least 10% Canadian ownership
3. you would have to be out of Canada for at least 6 months to qualify for any part of the $80,000 credit which takes a full twelve months to earn.
4. You have to have a family member living in the house you are maintaining in Canada.
In other words, it does exist AND it does apply to jobs in the US, even though it says "OVERSEAS". It just does not apply to you.
It is meant to compensate Canadians who are still taxable in Canda but working under harsh conditions in other countries and are separated from their families. It is not meant to compensate commuters.
The form to fill out is called a T626 and you can download it and read it at: http://www.ccra-adrc.gc.ca/E/pbg/tf/t626/t626-02e.pdf
By the way, I am in North Vancouver, BC and you are my third Windsor enquiry in two days. There must have been a local story of a border problem between Windsor and Detroit to prompt this number of enquiries.
