Canadian working in China and the US - A Question for

My question is: US-specific
QUESTION: I am a Canadian citizen who was assigned to work on an outsourcing project in China by a US company in California since January 2003 till December 1, 2003. I came back to the US company in December, 2003 after the project is finished. As I am NOT a US permanent resident or citizen, I was not a US resident during the period from Jan.2003 till Nov. 2003. Should my file as a part year resident in my 2004 income tax return and get paid tax refunded? Should I still pay social security tax for the period even though I was not a US resident?

david ingram replies:
You are not taxable in the US from Jan 2003 to the end of November.
However, the company likely deducted FICA (social Security), medicare and tax from you and will have the whole year on one W2.
You are likely taxable in Canada on that same money.
I do not have enough details.
Usually, you will have paid tax to China after three months or the company will have paid it for you..
Go to www.centa.com and read the 25 pages on US / Canada taxation. the sample tax cases will give you a good idea of where you stand.
We would be happy to assist you at tax time by fax, email, snail mail or courier and phone.
