Subject: Questions
Hi David,
I am a Canadian citizen working as an Analyst in Dallas, TX under a TN Visa
more then two years. I reside in Dallas City and work here 100% of the
time.
In 2001 I worked 8 months in Canada and remaining in USA and since then I
am here in USA and working in same company. In 2001 was not sure but I did
file tax returns in both the countries ( Canada & USA ) separately. Last
year I just filed Tax returns in USA and now am so confuse should I have to
file the same or should I have to file in Canada as well. I don't have any
ties, ( e.g. home, car, furniture, no property, family) except I do have
Bank account and Canadian credit cards and some stocks and that's it. But
one thing I got married last year and am going to apply her Canadian
immigration as well.
Could you please tell me what should I do, should I have to file tax return
in Canada and USA or just USA or ...... and how I proceed that. Thanks
and appreciated.

You should be filing a factual resident return in Canada because you have kept so much stuff in Canada and should be filing returns if you want to import a bride.
Under ART IV of the US / Canadian Tax treaty, you report all your US earnings on the Canadian returnand then you would deduct all your US earnings on line 256 of the Canadian Return.
Make sure that you report any Canadian interest and dividends on your US return.
We would be happy to look after this by mail or courier or fax.
