overseas employment tax credit - T626 - up to $80,

QUESTION:
Hello,
I'm a marine engineer employed by a major foreign oil tanker
(shipping) company that has offices in Vancouver. I am not
actually employed by the Vancouver branch, but rather from the
UK. Is there any way the OETC can be applied to my situation
without being a direct employee of the Canadian branch of said
company?
I have read through the literature on the CCRA website and the
legal jargon is so confusing, I thought it best to put the
question to the experts. I sincerely hope you have an answer for
me and the many Canadian seafarers who are in a similar
situation.
Thanks.

david ingram replies:
Unfortunately, the answer is no.
Working onboard a ship does not qualify for the Overseas
Employment Tax Credit (Form T626).
To qualify, you would need to be exploring for or extracting oil.
Transporting it does not qualify.
To be specific from bulletin IT 479R4 -
http://www.cra-arc.gc.ca/E/pub/tp/it497r4/it497r4-e.html
Qualifying Activity
6. For OETC purposes, a qualifying activity refers to the
qualifying activity of the specified employer and not that of the
employee. A qualifying activity includes:
(a) the exploration for or the exploitation of petroleum, natural
gas, minerals or similar resources;
(b) a construction, installation, agricultural or engineering
activity; or
(c) any prescribed activity. As per section 6000 of the
Regulations, an activity performed under contract with the United
Nations is a prescribed activity.
I am answering this again because when you phoned, I told you
that you also had to be maintaining a home in Canada with a
person in it who could be your dependent. That provision has
disappeared (it was unreasonable) in one of the many amendments
made and under the right circumstances, a single person does
qualify,
You can find the form at
http://www.cra-arc.gc.ca/E/pbg/tf/t626/README.html
IT bulletin 479R4 should be read in conjunction with the form
http://www.cra-arc.gc.ca/E/pub/tp/it497r4/it497r4-e.html
