david ingram replies:
She would have to be making over $115,000 a year Canadian to be in the 45%
tax bracket and even them, that bracket would only apply to the income over
$115,000. She or he would only be paying 25% up to $35,000 and there are 4
or 5 graduations from the $35,000 to the $115,000 depending upon what
province you are in.
What should be happening is that your daughter should be having 15% tax
deducted from her earnings while travelling in the United States. When she
files her US returns for the states she worked in and the US federal
government, that 15% may be enough or she m ay owe a little bit more or she
may even get a refund.
When filing her Canadian return, she will claim the federal and state taxes
she paid as a tax credit on lines 431 and 433 of her Canadian return. If
she is from Quebec, she will fill in the equivalent boxes on the Quebec
return (I am just too tired to look up the numbers at the moment).
It is NOT double taxation.
he will get credit in Canada for tax paid to the US or France or Germany or
New Zealand, etc.
The important part is to make sure that she fills in the relevant state tax
returns. Members of the Toronto touring company of Phantom of the Opera
were hit for state tax returns three years after their tour was finished.
Hawaii's penalties and interest were atrocious but the rules are simple.
Play a gig within a state and you have to file a state return. NBA
basketball player s and NHA hockey players all file more than 20 state
returns a year.
If you r daughter is a self employed performer, she may be able to deduct
some expenses - if she is an employee, it is not likely that "between gigs"
expenses would be deductible.
