TN Visa for Part Year 2005 - How to

Subject: TN Visa for Part Year 2005 - How to File?
Hello,
I worked and lived in the US (North Carolina) on a TN Visa from
June 2000 to May 2005. I have returned to Canada (Nova Scotia)
for now and am unsure how to file my 2005 returns. I've filled
out a Determination of Residency status with CCRA, will not find
out my status for many weeks.
How should I file my returns for Canada and the US for 2005?
Please advise. Thanks!

david ingram replies:
You will file a 1040 Dual Status return - check off line 39b and
you can only itemize deductions because of the dual status which
means that you have left the country and are a resident for part
of the year and a non-resident for the rest of the year. You
will file the North Carolina D400 return = pay attention to line
12 where you adjust your income as a part-year resident.
Then you file a 1040NR which will likely have a lot of zeros on
it. Mark "DUAL STATUS STATEMENT" across the top of page 1. This
tells the IRS that you did not have any US income after leaving.
If you did have US income after leaving, it might go on here or
stay on the original return.
For Canada, you will file the T-1 General and mark down the day
you arrived in Canada,. You will have to pro-rate the exemption
amount on line 300 of schedule 1 and the provincial 428 form.
If you need any help, this type of return is our specialty.

David Ingram specializes in giving expert income tax and
immigration help to American and Canadian citizens living out of
their home countries from Zimbabwe to Saudi Arabia to Mexico to
China or Chile - Cross border, Non-resident - dual citizen - out
of country investments are all handled with competence and
authority.
This is not intended to be definitive but in general I am quoting
$800 to $2,000 for a dual country tax return.
$800 would be one T4 slip one W2 slip one or two interest slips
and you lived in one country only - no self employment or rentals
or capital gains - you did not move into or out of the country in
this year.
$1,000 would be the same with one rental
$1,200 would be the same with one business no rental
$1,200 would be the minimum with a move in or out of the country.
These are complicated because of the back and forth foreign tax
credits. - The IRS says a foreign tax credit takes 1 hour and 53
minutes.
$1,500 would be the minimum with a rental or two in the country
you do not live in or a rental and a business and foreign tax
credits no move in or out
$2,000 would be all of the above and you moved in and out of the
country.
This is just a guideline for US / Canadian returns
We will still prepare Canadian only (lives in Canda, no US
connection period) with a three or four slips and no capital
gains, etc. for $100 or $125.00
With a Rental for $300
And an American only (lives in the US with no Canadian income or
filing period) with about the same things in the same range with
a little bit more if there is a state return.
.TDF 90-22.1 forms are $25 for the first and $10.00 each after
that when part of a tax return.
8891 forms are generally $50.00 to $100.00 each.
