Sponsoring husband to be into

Subject: Hello David
Importance: High
I just got off the phone with you re sponsoring my fiancé. Please
send me the info you referred to in our call as soon as you are
able. I will greatly appreciate it!
Also thank-you for your help, you are a very bighearted man.
With thanks,
---------------------------------
david ingram replies:
Canada abolished the fiancée visa in June 2002. You can only
sponsor a legal husband, a common-law husband or a conjugal
partner. If you have been living together on weekends while your
husband visits from the US and you can not go to the US because
of health and legal issues, you might qualify as a conjugal
partner. Evidence of a conjugal partnership would be joint bank
accounts for a year, commingling of assets, joint ownership of a
car, friends and relatives accepting you as a couple, etc..
However, your use of the word fiancée likely means that you are
not yet a couple and will have to get married to qualify even if
your relationship is a year old.
Your description of your husband to be's skills would likely mean
that he could apply for and get a job in Canada and be sponsored
by a potential employer much faster than you can get him in (with
the ability to work) with you as a sponsor.
Your income of $12,000 per year does "not" qualify you to sponsor
a husband from outside Canada. However, if you apply from within
Canada when your husband is in Canada, there is no income test.
The following will give you a list of what you will need to
sponsor your husband. I suggest that you contact the Dean of
Immigration in Vancouver. Don Cameron's number is (604)
303-9992.

QUESTION:
My wife has lived in Canada up until we found out it was faster
to her to
get in legally and work. she lived here for most of 2005 and did
not work. I
was the sole supporter whether she and her daughter were here or
in the US.
Can I claim her on my taxes this yr? what special forms, if any?
any other
special info I need?
-----------------------------------------------------------------
-
david ingram replies:
You may claim her as a dependent if you supported her whether she
was in
Canada all of the time or not.
However, as of Feb, 2005 it became much easier to sponsor your
wife from
within Canada.
The following previously answered question deals with the
paperwork you
need.
-------------
QUESTION: I'm a Canadian citizen and just got married. My wife is
a U.S.
citizen. I would like to apply for my wife's permanent residence
in Canada.
I would appreciate if you can tell me the process and how long
would it
take.
Thanks in advance
===========================================
david ingram replies:
You will have to decide on whether to apply from within or
without Canada.
Within would have her in Canada sooner but she can not work
unless she has a
work visa. If she has a university degree, she might qualify as
a
professional under Treaty NAFTA.
Basically to sponsor her, you need to fill in the following
paper work. At
the moment, it is likely taking up to 22 months and is processed
through
Buffalo New York
You can start the process by going to:
