QUESTION:
I am a Canadian citizen working in the US as a university professor on a TN
status.
I have been asked to consider accepting a Dean position. The position
includes a 50% load reduction from teaching. In other words I would be a
teacher 50% of the time and an administrator 50% of the time.
If I accept the position, is it possible to remain on TN status? If not
what would be my options?
Thanks

david ingram replies:
You are one of two non-client questions I am answering today out of 36 so
far.
In my opinion, you would no longer qualify as a TN. Being a Dean is not on
any TN occupational listing I have seen.
You should get an H1B. I agree that it would likely not ever trigger a
problem but if it did would be extremely embarrassing, costly and result in
your loss of the job at that time.
An advantage of an H1B is that you can also openly apply for a Green card
which although possible with a TN is also risky.
